건축물의 대지와 도로 Relation between site and road (1) (Feat. Concept of road and site access requirements under the Building Act)

건축물의 대지와 도로It is said that land on which buildings cannot be built is less valuable than land on which buildings can be built in terms of the limited ways in which it can be used to make a profit. Therefore, in order to judge the value of the land, it is necessary to focus on whether or not ‘buildings can be built’ on the land. In order to build a building, it is said that you must obtain permission from a permitting authority such as a mayor or county governor, rather than building it on your own. And the most basic thing that needs to be satisfied in order to obtain permission is ‘whether or not a road is secured to enter the building site’.
First of all, since the word ‘road’ came up, let’s look at what this ‘road’ is. The image that usually comes to mind is something like this.

However, when it comes to building a ‘building’, I don’t know what a road is or how it is organized. So, first, let’s look for the building code. Article 2, Paragraph 1, Item 11 of the Building Act states as follows.

It’s complicated, but first of all, in the Building Act, a “road” is defined as a “road with a width of 4 meters or more that allows pedestrians and cars to pass through.”

Earlier, when I was studying about the types of land (refer to the link below), I studied ‘land’ in the Building Act as ‘the land on which a building can be built’.
Various names for land (Feat. Lot, lot, land, site, parcel, residential land)
The essence of real estate is ‘land’ after all. The word ‘land’ is sometimes referred to as ‘earth’, but sometimes it is also called ‘lot’, and the word ‘parcel’ is used, and the word ‘land’ is heard, and the word ‘plot’ is also used. ‘long ago sat

And Article 44 of the Building Act summarizes the relationship between the site and the road like this.

This is where the word “presidential decree” comes in again. Searching for a link about what this is, it goes to Article 28 of the Enforcement Decree of the Building Act. Let’s take a look at this too.

Summarizing the contents of the Building Act and Enforcement Decree, in order to build a building on the site, a road with a width of 4 meters or more and the site of the building must be in contact with a road of at least 2 m or more. For reference, we have studied the concept of gross floor area before. (Refer to the link below)
Understanding the building area (Feat. Site area, building area, floor area, total floor area)
The word ‘area’ appears a lot in real estate-related articles or promotional materials for sale. What is the site area, how much is the floor area, what is the gross floor area, etc… At first glance, they are almost all similar.

Putting this into a table, it looks like this:

To make it easier to understand, let’s take a look at the pictures.

1) If the total floor area of the building is less than 2,000㎡

2) If the total floor area of the building is over 2,000㎡

Here’s a summary of what we learned today:

1. In order to judge the value of land, we must focus on whether or not ‘buildings can be built’ on the land.
2. To build a building, you need to obtain permission from a permitting authority such as a mayor or county governor, rather than building it on your own.
3. According to the Building Act, a road is a road with a width of 4 meters or more that allows pedestrians and cars to pass through.
4. In order to build a building on the site, the site of the building must be in contact with a road with a width of 4 meters or more and a road with a width of 2 meters or more, and if the total floor area is 2,000 square meters (3,000 square meters in the case of a factory) or more, it must be in contact with a road with a width of 6 meters or more by 4 meters or more.
